3M Class Action Lawsuit
In 2018, 3M was sued in a mass tort attorney lawsuit over allegations that its Combat Arms Earplugs Version 2 (CAEV2) were defective and caused hearing-related injuries to U.S. military personnel. The lawsuit alleged that the earplugs, designed to protect soldiers from loud noises such as gunfire and explosions, had a defect that allowed them to loosen without being noticed by the user. As a result, many veterans suffered hearing loss or tinnitus due to their use of the earplugs.
Attorneys for this mass tort attorney lawsuit argued that 3M knew about the design defect since 2000 but failed to disclose it. They also argued that 3M concealed information about the effectiveness of these earplugs from the U.S. government and that 3M sold defective earplugs to the U.S. military for over 10 years.
Subsequently a class action lawsuit was filed against 3M on behalf of those affected by the defective CAEV2 earplugs, claiming that 3M was negligent in its designs, manufacturing process, and marketing of the product. The lawsuit also sought compensation for medical bills, lost wages due to disability, physical pain and suffering, emotional distress, and other damages related to hearing loss or tinnitus associated with their use of these earplugs while serving in the military.
This mass tort attorney lawsuit is still ongoing as both parties attempt to reach a settlement agreement. All veterans who served in the U.S. military and used 3M’s earplugs are urged to seek legal counsel if they believe they have been affected by these defective earplugs.
