As far as liability, in Texas a social host is only civilly liable for damages or injuries if they knowingly serve a minor alcohol and that minor causes an accident. Criminally, a social host faces a Class A misdemeanor charge which is punishable by up to one year in jail and a fine of up to $4,000.

Dram shop law applies to establishments who sell alcohol to their customers. A liquor store, bar, dance club, concert venue and restaurant (if serving alcoholic beverages) can all be held liable for serving a visibly intoxicated customer who later causes a car wreck.
